How to Appeal Your Michigan Criminal Cas with An Experienced Appellate Defense Lawyer in Lansing, Detroit, Grand Rapids, Ann Arbor, and Throughout Michigan
The court that you need to appeal to after a criminal conviction in Michigan depends on the trial court you are appealing a decision from. In the state of Michigan, there are three different trial courts: the circuit courts, the district courts, and probate courts. The types of cases accepted and where appellate cases are heard is explained in this Michigan Judicial Branch organizational chart. If you have any questions about appealing a criminal conviction, or if you or a loved one is in need of experienced representation, contact Grabel & Associates now.
Michigan Circuit Court Appeal Cases
If you have been convicted in the district court, you may be able to appeal your case to the Michigan Circuit Court. The district court serves as the trial court for the federal court system, and is governed by Congress and the United States’ Constitution. Criminal and civil federal cases are heard in the district court system, and Michigan is home to four district courts:
- 1st District Court
- 2nd District Court
- 3rd District Court
- 4th District Court
Michigan Court of Appeals Cases
If you or a loved one is facing a conviction from the circuit court or probate court, your appeal may be heard in the Michigan Court of Appeals. The United States federal court system is made up of 94 judicial districts organized into 12 regional circuits, each with a United States Court of Appeals. These courts hear cases from not only circuit and probate courts, but district courts in the same regional circuit.
To file an appeal with the Michigan Court of Appeals, you must file to one of the four district court offices. Grabel & Associates has experience appealing circuit court, district court, and probate court decisions, and can represent you in your Michigan Court of Appeals case.
Michigan Supreme Court Appeals
When your Michigan Court of Appeals case is not successful, the next step is an appeal to the Michigan Supreme Court. While some cases can be directly appealed to the Supreme Court, many go first to the Michigan Court of Appeals. It is very rare to have your case heard by the Supreme Court, and by working with an experienced attorney throughout the post-conviction process, you will ensure you have the best chance at a successful Supreme Court appeal.
