Sobriety Courts
In the state of Michigan, there are specific Sobriety Courts to deal with repeat alcohol offenders. If you are facing a second or subsequent drunk driving conviction, you may be considered for Sobriety Court sentencing. This alternative sentencing and treatment can sometimes help clients avoid jail, or at least significantly reduce the criminal penalties for a DUI, OWI, OUIL, OWVI, OWPD, or Super Drunk Driving conviction. Our DUI lawyers in Michigan can immediately help you, if you are being investigated for alcohol or drug intoxication, or if you have already been charged with driving under the influence of drugs or alcohol.
Treatment and Alternative Sentencing Options for Repeat Offenders
Our experienced firm works with Michigan clients in even the most complex OWI cases, and our aggressive criminal defense has been effective in thousands of past cases statewide. Let us help you discover treatment options or alternative sentencing options while fighting to protect your rights and freedom. We want to get you back on the road as soon as possible after a DUI conviction, and will represent you in Sobriety Court to help you avoid extended license revocation, increased fines, or unnecessary jail time.
Sobriety Court Law in Michigan
If you are convicted of operating while intoxicated under Section 257.625 of the Michigan Vehicle Code, you could have your license suspended or revoked. However, under sobriety court laws, you may be eligible to regain a restricted license after 45 days, as long as you are admitted into a DWI/Sobriety Court program, and install an ignition interlock device on your vehicle. This restricted license would allow you to drive to and from home and work, as well as to alcohol, drug, or mental health treatment, court hearings, alcoholics anonymous or other court-ordered programs, community service, school, college or university, and more.
Sobriety Court programs can last up to 2 years, and can involve court ordered self-help programs (such as AA or NA), community service, drug and alcohol testing, and other restrictions. These restrictions will be gradually reduced, and are designed to help repeat offenders prevent relapsing or re-offending in the future. Sobriety Courts are designed to reduce incarceration, limit the number of cases in regular courts, and reduce repeat offenses for substance-abuse crime. If you do not have a history of felony conviction for a violent crime, and have been charged with OWVI, OUI, DUI, Child Endangerment, or other alcohol offenses, you may be eligible for Sobriety Court. Contact Grabel & Associates to find out more, and read Section 257.304 of the Michigan Vehicle Code. We will help you understand how the law affects your unique case and guide you through the criminal process in order to help you achieve the best possible result.
