In the state of Michigan, you have the right to complete your case proceedings within 180 days; however, this rule is not always acknowledged unless you are waiting in jail for a hearing. Another rule in the state gives you the right to have your DUI case arraigned within 14 days of arrest, while the time before trial should be 35 days, and the fully resolved case should be completed within 77 days. Additional rules coming from Administrative Order 2003-7 state that 90% of misdemeanor cases should be completed within 63 days, and 98% within 91 days. For felony DUI cases, the courts should begin preliminary examination within 2 weeks (14 days). These guidelines are not strictly adhered to, though some judges will comply with these time limits.
According to a court statute that went into effect in 2006, all drunk driving cases must be resolved within 91 days. This rule was later amended to allow 126 days for decision by either a guilty plea, or a court decision. These strict limits make it even more crucial to hire a lawyer as soon as possible, as you will be pressed for time to build a comprehensive defense strategy and collect all the necessary information to beat your DUI charge.
