Homicide/Murder: Within Chapter XLV of the Michigan State Penal Code, there are several definitions for homicide, ranging from first-degree murder to assisting in suicide. First-degree murder is punishable by life imprisonment without the possibility for parole. Delivery of schedule 1 or 2 substances, causing the death of that person, is a felony punishable by life imprisonment or any number of terms. Manslaughter is a felony punishable by imprisonment of not more than 15 years or by a fine of not more than $7,500, or both.
Negligent Homicide: In the State of Michigan, reckless driving that leads to the death of another could result in homicide charges. However, if the accident was unintentional, negligent homicide is a misdemeanor punishable by up to two years in prison and a fine up to $2,000.
Self Defense: If you used self-defense in a violent situation, you should not unjustly suffer from criminal charges and penalties.
Aggravated Assault: Although aggravated assault is a misdemeanor in Michigan, police and prosecutors tend to look for ways to intensify the charges to bring about a felony conviction. For example, assault without a weapon that causes aggravated injury could result in imprisonment up to one year and fines up to $1,000. Assault with intent to do great bodily harm, on the other hand, can result in a prison sentence of up to 10 years and up to $5,000 in fines.
Assault and Battery: Those convicted of assault and battery could be facing a misdemeanor with up to 93 days in jail and a fine up to $500. This is, of course, assuming that no other criminal penalties are present.
Domestic Violence and Spousal Abuse: Domestic violence often receivers harsher penalties than assaults. In a domestic assault case (not aggravated domestic assault), whereas the victim does not require injuries, the first conviction is a misdemeanor punishable by no more than 93 days in jail and/or a $500 fine. For a 3rd domestic assault conviction, the defendant could be facing a felony punishable by up to two years in jail and/or a $2,500 fine.
Gang Violence: Michigan defines a gang as an ongoing organization of five or more people that identifies itself by a unifying mark or method, an established command structure, and defined membership criteria. If convicted of a crime, jurisdictions have a set charge or enhanced penalty for crimes committed for the benefit of the gang.
