UDAA Charges in Southfield
There is no “grand theft auto” charge in Southfield, though there are a number of other serious criminal charges that apply to auto theft cases. The easiest for the prosecution to prove is UDAA, or Unlawfully Driving Away an Automobile, which is covered by Section 750.414 of the Michigan Penal Code. According to this section, anyone who takes or uses a motor vehicle without authority can face up to 2 years behind bars and a $1,500 fine. This section does not involve intent to steal, however. Anyone who steals a vehicle could face additional penalties under separate legislation, as outlined below.
Possessing or Concealing a Stolen Motor Vehicle in Southfield
If you buy, receive, possess, conceal, or aid in the concealment of a stolen motor vehicle, you could face up to 10 years behind bars and a fine of at least $15,000, or 3 times the value of the stolen vehicle, whichever is greater. If the vehicle is valued at less than $20,000, the below penalties could apply:
- Vehicle worth between $1,000 and $20,000: Up to 5 years in prison and a $10,000 fine, or a fine of 3 times the value of the stolen vehicle.
- Vehicle worth under $1,000: Up to 1 year behind bars and a fine of $2,000 or three times the value of the stolen vehicle. This offense is a misdemeanor, as opposed to other offenses which are felonies. It is unlikely, however, that a vehicle will be appraised at less than $1,000 for purposes of this legislation.
Always protect yourself if accused of stealing a motor vehicle or unlawfully driving a motor vehicle away, even if you didn’t actually intend to steal it. Our lawyers can help you fight for a case dismissal, reduced charge, favorable deal, or other outstanding result.
