Solicitation, Accosting, Admitting for Purpose of Prostitution, or Engaging Services for Prostitution
There are at least three specific sections of the Penal Code dealing with solicitation and related offenses. Section 750.448 pertains to soliciting, accosting, or inviting another person to commit prostitution. Any person over the age of 16 who accosts, solicits, or invites another person from a building or vehicle, by word, body language, or any other means, to commit prostitution or commit any other lewd act. If a person over the age of 16 admits another person to any place for the purpose of prostitution, he or she can face punishment pursuant to Section 750.449. A person who engages the services of another for prostitution is likewise faced with criminal conviction, under Section 750.449a.
The penalty for any of these offenses is a misdemeanor record, up to 93 days behind bars, and a $500 fine. With a prior conviction on record, up to a year behind bars and a $1,000 fine could result. With 2 or more prior convictions, up to 2 years behind bars and a $2,000 fine will be on the line. These penalties are covered under Section 750.451.
Prostitution, Aiding and Abetting, and Pimping and Pandering in Kalamazoo
Admitting a person into a place for the purpose of prostitution and aiding, assisting, or abetting prostitution, can both result in penalties covered under Section 750.451. If a female less than 16 years of age is allowed to remain in a house of prostitution (not as a working prostitute), the same penalties will be on the line. Detaining a person in a house of prostitution for repayment of debt is a felony punishable by up to 20 years, with a minimum sentence of 2 years behind bars, pursuant to Section 750.458. Accepting or receiving the earnings of a prostitute can also lead to 20 years behind bars.
In solicitation and prostitution cases, many different criminal charges and legal issues can stack up and lead to extremely harsh criminal penalties. Contact our firm now to learn more about the specific issues involved in your case.
