Kalamazoo Juvenile Criminal Sexual Conduct Attorney
In Michigan, the age of consent for sexual activity is 16, which is very close to the age at which a person is considered a juvenile (under 17). With such little overlap between the two, most sexual contact between minors is actually against the law, even if they believe it to be consensual. Criminal sexual conduct normally involves sex with a minor, sexual assault, and other unlawful sexual contact, but in juvenile crime cases, it may even be the case that the offender had no idea what he or she did was against the law. As a result, juvenile criminal sexual conduct in Kalamazoo can be a confusing issue, and many persons who are accused of juvenile sex offenses don’t know where to turn. Criminal Sexual Conduct Laws and Juvenile Sex Crime Defense
In regular criminal cases, there are four degrees of criminal sexual conduct. CSC in the 1st degree occurs when sexual penetration is committed with a person under 13, or a person between 13 and 16 with other mitigating factors such as force or authority in play. Second degree CSC is similar, but results in cases where only sexual contact, and not penetration, is present. CSC in the third degree results in all other penetration cases involving a person under the age of 16, or penetration cases where mitigating factors are present, as outlined in Section 750.520d. CSC in the fourth degree, similarly to second degree charges, involves only contact.
It is understandably difficult for persons under the age of 17, otherwise known as juveniles, to avoid breaking these laws. Essentially, all sexual contact involving a person under the age of 15 is criminalized. While the juvenile courts may be able to treat these cases differently and prescribe penalties not quite as serious as the life imprisonment threatened under criminal sexual conduct laws, these cases are still always very serious. Work with a lawyer and fight back against the serious penalties that are likely on the line in your case.
