Criminal Sexual Conduct in the Third Degree in Grand Rapids
There are a number of situations in which sexual penetration can result in 3rd degree CSC charges, and it is critical to work with an attorney so that you understand what prosecutors will be trying to prove and how you can effectively defend yourself inside and outside the courtroom. If a person engages in sexual penetration with another person who is between the ages of 13 and 16, CSC in the third degree charges are possible. The defendant may also be accused of using force or coercion to accomplish sexual penetration, which is likewise a third degree offense. If the alleged victim is mentally incapable or physically helpless, and the alleged actor had reason to be aware of that condition, he or she may be found guilty of Criminal Sexual Conduct. If sexual penetration occurs between two persons related by blood or affinity to the third degree and is not considered unlawful by any other statute, 3rd degree CSC charges can result (unless the two are lawfully married).
If the alleged victim is over the age of consent (16) but still under 18 years old and the actor is a teacher, substitute, administrator, employee, volunteer or contractual service provider of the school the alleged victim attends, he or she may be guilty of CSC. In cases involving special education, this applies to persons as old as 26 years of age. CSC charges can also occur when a person licensed to operate a foster family home or group, a volunteer of a child care provider, or an employee of a child care organization engages in penetration with a resident over 16 years of age.
