Federal Sentencing Guidelines for Michigan Drug Crime
In 1987, the United States created federal sentencing guidelines for criminal felony and serious misdemeanor charges in the federal court system. These guidelines aim to create a uniform sentencing policy for those convicted of serious crimes. Based on the crime, factors involved in the crime, and the criminal history of the accused, a base offense level will be set, up to the most serious level of 43. A judge then will determine a sentence, which may be influenced by the federal guidelines for that base level.
Contact Grabel & Associates if you are facing a serious drug crime charge, such as felony drug trafficking, possession with intent, cultivation or manufacture of drugs, or any other crime. Our attorneys will fight for your rights and earn you a great case outcome anywhere in Michigan.
Federal Sentencing Guidelines for Heroin, Cocaine, Marijuana, Meth, and Other Drugs in Michigan
According to the Federal Sentencing Guidelines of 1987, the guidelines for specific illegal substances are as follows:
Heroin- Less than 5 kg will result in a base offense level of 12, and the defendant could face up to 16 months in prison. A conviction involving more than 30 kg of heroin will result in a base offense level of 38, which can lead to over 24 years in prison. If the defendant has a criminal history, or was involved in a violent drug crime, the base offense level could increase.
Cocaine- Less than 25 grams will result in a base offense level of 12, while over 150 kg of cocaine or crack will result in a base offense level of 38. Penalties for the base offense levels are the same as in heroin cases, and specific factors of the drug crime case can result in an increase in the base offense level.
Methamphetamines- Less than 2.5 grams of meth can result in a minimum base offense level of 12, while possession of 15 kg or more can result in a base offense level of 38, along with corresponding criminal penalties.
Marijuana- Under 250 grams of marijuana can result in a minimum base offense level of 6, while over 30,000 kg of marijuana will result in a base offense level of 38.
