The Michigan Medical Marijuana Act outlines who is eligible for medical marijuana, and some of the restrictions patients and caregivers face. According to the act, medical marijuana caregivers must be over 21 and have no felony criminal history in order to possess, cultivate, or transport medicinal drugs with a license. Caregivers cannot assist more than 5 patients at one time.
Patients must also qualify for a medical marijuana registration card, and need to prove that they suffer from a debilitating medical condition, like HIV/AIDS, hepatitis C, Alzheimer’s, or glaucoma. Seizures, muscle spasms, and other conditions causing chronic pain are also considered, though each case is individually evaluated before a registration card is issued. No minimum age technically exists for patients; however it is extremely rare that anyone under the age of 18 is issued a card.
If you possess medical marijuana and are not legally registered, or if you possess more than the allowed amount of 2.5 ounces, you can face up to 2 years in prison and a fine of up to $2,000. If you cannot prove that the marijuana was medicinal, you could face much more serious penalties, outlined in the Michigan Penal Code.
