There are three degrees of home invasion charges that a person can face, under Section 750.110a of the Penal Code. The most serious, first degree home invasion, results in cases where a person breaks and enters into a dwelling, or enters without permission, with intent to commit a larceny, assault, or felony (or without prior intent but actual commission), if the offender is armed with a dangerous weapon or if another person is lawfully present in the dwelling at any point during the offense.
Second degree home invasion charges result when a person breaks and enters or enters without permission with intent to commit a felony, larceny or assault, or when he or she unlawfully enters or breaks and enters and actually does commit one of these offenses, without other mitigating factors.
Third degree home invasion charges result when a person breaks and enters or enters without permission and commits or intends to commit a misdemeanor, or when a person breaks and enters or enters without breaking and violates a probation term, parole term, restraining order, or bail/release condition.
All three degrees of home invasion can lead to felony conviction, and any breaking and entering or home invasion offense should be handled by an experienced defense attorney. Contact our team now for a free initial case consultation and let us begin fighting to protect you.
