One of the most prominent pieces of evidence used against suspects in drunk driving cases is often blood alcohol content testing. Police use roadside BAC tests to establish probable cause to arrest a suspect, and usually supplement this evidence with a secondary blood or breath test after the suspect is in custody. These tests are not 100% accurate, however, and careful attention to detail is necessary to ensure incorrect results do not affect the outcome of a Detroit DUI case. Grabel & Associates has the knowledge and experience needed to protect against BAC test errors and will fight to protect you from wrongful conviction due to breathalyzer test mistakes. We know what it takes to overcome BAC evidence and achieve a just result in your OWI case, and our Detroit DUI lawyers are always available to begin working together with you in your unique case.

There are two main types of blood alcohol content tests commonly used in Michigan. These tests measure the amount of alcohol in your system as a percentage, and any BAC over 0.08% allows officers to proceed as if a suspect is legally intoxicated, regardless of any other evidence that may or may not be present. In some cases, such as those involving commercial drivers or persons under the age of 21, the legal BAC limit is much lower than 0.08%.
The first of the two types of tests is a breath test, commonly referred to as a Breathalyzer test. This test can be administered roadside using a portable Breathalyzer device, though these are not as accurate as most other chemical tests.
The second type of BAC test is a blood test, which is known to be more accurate than a breath test, though mistakes can still occur in many cases. Blood tests are to be administered under the supervision of a trained medical professional, and are usually administered after a suspect has already been taken into custody.
A third type of test, a urine test, is rarely used in DUI cases, though it can be used in cases involving driving while under the influence of drugs. Our lawyers are familiar with all three of the chemical tests that can be used and the potential errors that need to be challenged when fighting an OWI conviction in Detroit. Common mistakes made during blood alcohol content testing include:
Though breath tests are not always accurate, it is still usually not a good idea to refuse to take one, even if you believe it may read that you are intoxicated. Refusing a roadside breath test is illegal, as anyone with a driver’s license has already signed off consent to submit to any lawful request for a BAC test made by an officer. If you refuse to take a Breathalyzer test, you could lose your license for 2 years or more, and police will still likely have probable cause to arrest you and charge you with OWI.
